摘要
权利与权力的博弈是宪政制度产生的动力,当公共空间从个人的集合中产生出来,个人权利和公共权力之间的矛盾与冲突就从未停止过。然而这两者并非永远处于对立的两极,将和谐的理念引入法律的建构,可以通过法律既保障个人权利的实现又畅通公共权力的实施,从而真正实现社会和谐。
The conflict between right and power has been the impetus for forming Constitutionalism,and with the public space deriving from the aggregate of individuals,the struggles and conflicts between personal right and public power have never stopped.However,both of them are not always standing in the opposition,if we can construct our legal system with harmony,we can not only protect the personal rights,but also have the public power implemented well,and then we can achieve the harmony of whole society.
