试析道德评价与法律评价相悖现象成因及其调整

Study on Causes of Contrary Phenomenon Between Moral Evaluation and Legal Assessment and Its Adjustment

由于道德评价"义务"本位与法律评价"权利"本位差异,道德评价的主动性与法律评价的被动性差异,道德评价的多变性与法律评价的相对稳定性差异,在现实生活中出现了法律保护和道德提倡相悖的现象,这些现象在社会上引起了许多争论和困惑,它"颠覆"着人们对道德的信念和法制的信心。因此应在立法中吸收道德内容、寻求道德与法律的平衡点,以道德评价监督法律评价,不断提升全社会的道德评价和法律评价的水平,减少道德评价与法律评价相悖现象的产生。

As the differences between the duty-soriented moral evaluation and the rights oriented legal assessment,differences between initiative moral evaluation and passivity of legal evaluation,differences between variability of moral evaluation and stability of legal evaluation,the contrary phenomenon of law protection and moral avocation has appeared in real life.In order to reduce the phenomenon,we should absorb the moral contents,seek the balance between legislation and morality and supervise legal assessment by use of moral evaluation to improve continuously the level of moral evaluation and legal assessment of the whole society,and to reduce the contradictions between moral evaluation and legal assessment.
