Research on Legal Issues of Judicatory Appraisal in Cases Involving Insurance Disputes

司法鉴定是指运用专门的科学技术、方法与手段来对诉讼过程中所涉及到的问题进行鉴别、判断与认定。在涉及保险纠纷案件中,司法鉴定问题是一个不可忽视的问题。司法鉴定的结果直接关乎案件当事人各方的赔偿数额问题,因此,司法鉴定问题越来越引起案件当事人各方的关注。但是,目前,对涉及保险诉讼案件中的司法鉴定程序的启动问题、司法鉴定结论的效力及内容的合法性问题一直以来研究较少,需要引起应有的重视。

Judicatory appraisal refers to use specialized scientific techniques、ways and means to judge、identify the problem during the proceedings.In cases involving insurance disputes,Judicatory appraisal can not be ignored.The results of judicatory appraisal directly connected with the amount of compensation for the parties,Therefore,the parties concerned have increasingly concerned about the judicatory appraisal.However,at present,in cases involving insurance disputes,the start of program of judicatory appraisal and the judicatory appraisal conclusions and the legality of the content have been less research,which needs attention.
