改革行政复议制度的几点思考

Reflections on the innovation of administrative reconsideration system

行政复议制度在我国已确立多年,目前实践的主要状况为行政复议案件数量不多、复议决定维持率过高、复议程序过于行政化等,导致该制度面临着公信力缺失和效率优势无法发挥的困境。通过分析其原因,应当从如下方面加以改革:扩大行政复议受案范围,使合法权益受侵害的行政相对人都能得到救济;设立专门独立的行政复议机构,使其不受外力干涉自主作出复议决定,提高复议公正性;设置行政复议工作人员任职资格制度,提高行政复议质量;加强行政复议司法化,将实现程序正义的一些最基本的司法制度运用到复议过程中。

Administrative reconsideration system has been implemented in our country for many years.However,the reconsideration cases are relatively few,the rate of maintaining conclusion is too high,and the reconsideration process is too much administrationized.All these resulted in the loss of credibility and poor efficiency.After analyzing the causes,we should reform it from the following aspects： enlarge the scope of administrative reconsideration to ensure every victim get relief;set up a special independent administrative reconsideration organization to make a reconsideration decision without outside interference and enhance impartiality of reconsideration;establish the administrative review system for staff qualifications and improve administrative reconsideration quality;strengthen the judicial administrative reconsideration,and apply the most basic system of justice to the reconsideration process in order to achieve procedural justice.
