我国工会法人民事权利探析

The Analysis on Legal Representatives' Civil Rights of the Trade Unions of the Nation

工会法人依法可独立享有民事权利,承担民事义务,既具有法人共有的民事权利,也具有自己特有的民事权利,即为实现工会维护职工权益之特有宗旨所需要的民事权利,主要包括代表权和监督权。但工会法人不应具有从事营利性活动的权利。

The legal representatives of the trade union have the civil rights according to the law.In the meanwhile,they should bear the civil responsibilities. They have the common civil rights which the others have,and have their own special civil rights as well,that is,to have the civil right to achieve the goal of the trade union for safeguarding the staff＇s rights including the right of representative and right of supervising.However,the legal representatives of the trade union should not have the right to join some activities which can make be nefits.
