检察机关如何加强对社区矫正执法环节的法律监督

Ways for the Prosecutorial Agency to Enhance Legal Surveillance on the Law Enforcement of Community Correction

我国宪法明确规定,检察机关是国家法律监督机关,而作为行刑方式之一的社区矫正同样也需要检察机关的法律监督。在社区矫正的法律监督中,检察机关应着重对相关职能部门、社区矫正活动全过程和社区矫正对象进行监督。要更好地发挥检察机关的法律监督作用,就必须从原则性和具体规范两方面来构建检察机关对社区矫正执法环节法律监督的机制。

The constitution of china confirms that prosecutorial Agency is the agency of legal surveillance.Community correction,as one of penalty execution,also needs legal surveillance form prosecutorial Agency.For legal surveillance about community correction,prosecutorial Agency should focus on relative functional departments,the whole course of community correction and the objects of community correction.In order to display function of law surveillance better,we have to build legal surveillance mechanism form two elements of basic principles and exact standards.
