Consummating Patent Policy and Promoting Enterprise's Innovation

专利制度是世界各国广为采用的促进企业创新的政策,它可以保障创新者在一段时间内对创新成果的独占权,但由于许可垄断也导致了社会福利损失。本文研究了专利制度设计的方法和原则,在此基础上分析了我国专利制度存在的问题,并提出了相应对策。

Patent policy is used widely in lots countries as a policy to promote enterprise＇s innovation,it can guarantee innovator＇s exclusive right in a period of time,but it also induces the social welfare loss due to monopolize.We study the measure and principle in designing patent policy,then analyze the existent problems of Chinese patent policy and advance the correspond countermeasures.
