实现“工学结合”人才培养模式的法律制度研究

A Study of the Legal System to Help Guarantee the Talents-Cultivating Mode of "Combing Work and Study Together"

我国高职教育虽在理念上形成了工学结合人才培养模式,但保障该模式顺利推行的制度建设则相对落后,尤其是保障工学结合模式顺利实现的法律制度更是缺失,未能成为推动社会产业、经济以及教育本身发展的强有力的内在动力。目前,应从职业教育发展所遭遇的现实困境以及法律困境入手,积极探寻并构建我国实现工学结合人才培养模式的法律制度体系,这种法律制度的构建应当以经济的发展为驱动,政府在其中起重要的引导作用,法律体系的内容应当包括高职教育法律法规的制定与完善、工学结合模式主体权利与义务的规定、高职教育的执法监督等内容。

Although the concept of talents-cultivating mode of having work and study combined together has been formed in the field of higher professional training in our country,the relevant mechanism construction that serves to guarantee the smooth promotion of this mode has lagged behind.Moreover,there is no legal system which helps guarantee the realization of this training mode,which fails to make itself then inner motive to promote the development of social industry, economy and education itself.At present,we should make great efforts to,from the realistic and legal predicaments of professional education,explore and construct the legal system to guarantee the training mode of having work and study combined together.This construction should take the development of economy as its inner motive and government should play an important guiding role in this construction.The contents of this legal system should consist of the establishment and perfecting of legal regulations,the main body rights and obligations of the work-study-combination mode,the supervising of the administration of higher professional education,etc.
