现行法院单方退出机制存在问题及其完善

On the Existing Problem of Unilateral Withdrawal Mechanism and the Perfection of Fair and Honest Administration of Justice

重庆等地法院推行的单方退出机制是促进公正廉洁司法的一次制度创新和尝试。目前,单方退出机制存在调整范围过小、涉嫌违法和配套制度缺乏等问题。完善单方退出机制,需要进一步扩大单方退出机制的调整范围、建立健全相关配套制度、探索科学合理的退出方式,避免违法嫌疑。

The implementation of the unilateral withdrawal mechanism in the courts of Chongqing and other places is a system innovation to promote a fair and honest Judicature.At present there exist some problems such as too small adjustment range and lack of law,etc..To complete the unilateral withdrawal mechanism,we need to further expand the scope of the adjustment mechanism of unilateral withdrawal,establish and improve the related systems,explore scientific and reasonable approach in order to avoid the suspect of illegal offense.
