论中华传统武术的法律保护模式构建

Research the Building up the Mode of Legal Protection of Traditional Chinese Wushu

建立起一整套的法律、法规,以保护中华传统武术已是学者们的共识。分析指出对传统武术在宏观上进行保护模式的构建是建立这种法律制度的理论基础,我们应加快综合性及专门法律、法规制定的步伐,实现国内法律与国际条约接轨,以地方性法规配合全国性法律、法规实施,强调民族主体权利优先、同时兼顾个人主体权利,采取防御性与救济性法律保护综合措施,最终构建起中华传统武术的法律保护立体模式。

Establish a set of laws and regulations to protect the traditional Chinese Wushu is the consensus of scholars.Analysis of that of traditional Wushu in macro mode on the protection of the building is the establishment of such a legal system based on the theory.We should speed up the process of formulate comprehensive and specialized laws and regulations,link domestic law with international treaties;local laws and regulations coordinate with national laws and regulations;stress the main national priority rights,and at the same time,taking into account the main individual rights;take composite legal protection of defensive with relief measures,and finally build the three-dimensional model of legal protection for traditional Chinese Wushu.
