行政柔性执法并不是空穴来风,而有其坚实的理论依据,具体来说,以人为本的理念、法律的正当性理论、行政法中的"可接受性"理论、行政法中的"平衡理论"以及公共管理中的协调理论是推行行政柔性执法的理论支撑,论文主要论述了柔性执法的理论基础,为指导柔性执法具体实践提供了依据。

The bases of administrative guidance in Executing law include： the People-oriented theory,the legitimacy of law theory,acceptable theory,balance theory,coordinate theory etc.This paper concentrates on the theoretical bases of administrative guidance in executing law for the purpose of improving the level of actual law execution.
