我国夫妻关系法的社会性别分析及完善

Gender Analysis in the Law of Marital Relationship and Its Improvement

社会性别的法律分析方法要求充分考虑女性和男性面对的不同社会现实,分析法律规定对女性和男性的不同影响,尤其是可能给女性带来的负面影响,进而修改法律,以期实现男女之间的真正平等。我国现行婚姻法规定夫妻在家庭中地位平等,但自社会性别视角观察,夫妻关系法中有些规定仍然存在着性别盲点,缺乏社会性别意识,其实施的结果并不能真正使女性获得与男性完全平等的法律保护,有必要对相关立法予以完善。

The legal method of gender analysis requires that we should explore the social realities women confront,which are different from those men face,and that we should analysize the influence of law on men and women,particularly the negative impact on women,and then amend laws to realize the substantial equality between men and women.Marriage law of China provides that men and women have equal positions in families,but examining the current law of marital relationship from the visual angle of gender,due to the shortage of gender sense in some provisions,it can＇t protect women as equally as men.So it is necessary to improve laws related to marital relationship.
