论我国公安机关侦查职权的合理配置

On the Rationality of Authority Disposition in the Investigation Procedure of Public Security Organs

基于侦查价值多元化的考量,现代刑事诉讼中的侦查程序并非仅是行使侦查权的载体,而是与侦查活动有关的多种职权相互协调的过程。因此,只有对侦查程序中的各种职权予以合理配置,才能达到既保障侦查权的充分行使,又能够对侦查权进行必要制约的目的。

Based on the examination of the multiplication value of investigation procedure,the investigation procedure in modern criminal procedure is not only a carrier of exercising the investigation power,but also a coordinative process of varieties of authority related with investigation activities.Therefore,only after distributing each kind of authority in the investigation procedure rationally,shall we achieve both goals of safeguarding full exercise of investigation power and carry out necessary restriction to the investigation power.
