乡村法制建设中遇到的问题及对策——基于“民间法”的角度

Problems and Countermeasures about Rural Legality Building——Based on Point of View of " Folk Law"

中国农村的村民自治制度已经实行多年,中国法制现代化程度也有了很大提高,但在许多农村地区还存在着传统留下来的"民间法",它在处理农村人与人之间关系、调节纠纷方面存在一些积极作用,但很多时候它的负面部分与现代法制产生了冲突。建设和谐农村、现代化农村,有必要化解"民间法"与现代法制的冲突,改造和引导"民间法"以切合现代法制精神。

Self-governance among villagers has been carried out for years in the countryside of China and the level of Chinese legal modernization is improved significantly.However,the traditional ＂ folk law＂ still exists in many rural areas.To some extent,it plays an effective role in handling the relationship among villagers and adjusting disputes.Whereas,in most cases,its negative effects are in conflict with the modern legal system.To construct hamonious and modern countryside,it is necessary to resolve the conflict between ＂ folk law＂ and modern legal system,remake and guide the ＂ folk law＂ suiting the spirit of modern legal system.
