On How Constitution Become the National Basic Law

宪法一开始即以根本法的形式存在,其正当性源于人民主权原则,宪法既是国家统治的最高政治规则,又是限制国家权力、保障公民权利的根本法律规范,还是统摄一国内一切公法与私法的最高法规范。明确宪法作为根本法的性质和地位是我国现行宪法的显著特点,宪法实施是一项政治机制和法律机制协同作业的系统工程,只有"政治的归政治,法律的归法律",才能真正实现宪政和宪治的宏伟蓝图。

Constitution comes into being as the form of basic law,whose legitimacy originates from the principle of sovereignty of the people.Constitution is not only the supreme political rule of national government,but also the basic legal norm that limits national rights and gurantees civil rights,also the supreme law that governs all national public law and private law.One of the prominent characteristics of Chinese current constitution is that the constitution has been specified its nature and place as the basic law.The implementation of constitution is a system that coordinates the political and legal mechanism.Only ＂those political issues belong to politics and those legal issues belong to law＂ that the grand blueprint of constitutional government and constitutional management can be really realized.
