论祖国大陆亲属法通则性规定的确立--以海峡两岸亲属制度之比较为视角

On the Establishment of General Principles of Family Law Provisions in the Mainland: By Comparing the Different System between Taiwan and the Mainland

《亲属关系通则》的缺失是我国祖国大陆《婚姻法》经2001年修改后仍存在的一个重大遗憾。亲属关系通则有自身的功能及特定的价值取向,建立该项制度有它的实际意义,对祖国大陆和我国台湾相关立法的介绍评析,一方面指明了我国中国大陆地区亲属立法中存在的不足,另一方面有针对性地提出了部分立法建议,以求为我国祖国大陆亲属立法之完善提供一定的参考。

The lack of ＂the general rule of kinship＂ is a big loop of our country＇s family law which has been amended in 2001.This article begins from the functions and values of the general rule of kinship,analyzing the actual significance and the basic direction.Combined with the introduction of Mainland of China and Taiwan on related legislation,on the one hand,this study points out the flaws in legislation of the China's Mainland,on the other hand,it makes pertinent legislative proposals in order to provide a relative reference to improve our country＇ s family law.
