"公民不服从"是一个来自西方的概念,有多种理论试图为其正当性提供强有力的根据。"公民不服从"的发生除需满足公开性、非暴力性等内在要求外,还具有严格的外在条件限定。公民不服从在实施过程中存在着潜在的可能危险。我国的法制建设在积极完善自我的同时,应该充分发挥公民不服从对法制建设的积极作用,从而为我国中国特色社会主义建设提供制度支持。

＂Civil disobedience＂ is a concept coming from the west.There are a variety of theories attempting to provide a strong basis for its legitimacy.＂Civil disobedience＂ must meet the intrinsic requirement of openness and non-violence,but its external conditions are also strictly limited.There may be potential risks in the implementation process of civil disobedience.China＇s legal construction should give full play to the positive role of civil disobedience to the legal system construction in a positive self-improvement at the same time so as to provide institutional support to the China＇s socialist construction with Chinese characteristics.
