当前政府禁止农村宅基地使用权流转并不具有正当性。政府应将公平与正义作为核心价值理念,充分尊重农民土地权益。政府应确立完善的农村宅基地使用权登记制度,逐步建立农村宅基地有期限、有偿使用和收回制度,在条件成熟时以立法形式规范农村宅基地使用权的流转。

It is illegitimate for the government to forbid the homestead circulation in rural areas.The government shall take fairness and justice as the core value and respect the land rights of farmers.It is argued that a sound registration system should be established in the rural residence land use,and a system of paid use of rural residence land for an agreed period should be introduced.
