利用影响力受贿罪既与受贿罪是两个截然独立的罪名,又不属于职务犯罪的范畴,但在程序上却归人民检察院专属管辖。从身份犯的视角考察利用影响力受贿罪,其犯罪主体仅限于国家工作人员的近亲属及其他关系密切的人,同时不以被利用的国家工作人员是否知情为必要条件。而在对向犯的基点上,将利用影响力受贿罪的对向行为犯罪化既符合对向犯的基本理论,又顺应我国当前的反腐需求,并有利于保持贿赂犯罪立法体系的均衡。

The crime of accepting bribes by influence and crime of accepting bribes are different crimes respectively,and neither belongs to the scope of crime of taking advantage of duty,but both are under the people＇s procuratorate exclusive jurisdiction in procedure.Considering the crime of accepting bribe by influence from the angle of status offense,subject of crime is restricted to state functionary＇s close relatives and others,and not take whether the state functionary knowing the facts as its prerequisite.Basing on the symmetrical offense,the criminalization of the symmetrical act of crime of accepting bribes by influence is not only accord to basic theory of symmetrical offense,but also comply with present need of anti-corruption in China,and is benefit to keep balance of legislative system of bribe crimes.
