Legal study on the New Rural Cooperative Medical System based on the analysis tool of soft law.

新型农村合作医疗立法是规范新型农村合作医疗社会关系的需要,保障新型农村合作医疗持续发展的需要和实现依法治国、构建和谐社会的需要。新型农村合作医疗进入全面实施阶段为立法提供了时机和条件,新型农村合作医疗现有的政策规范和地方政府规章为立法提供了制度资源,新型农村合作医疗立法具备了良好的政治基础和群众基础。提出了进行新型农村合作医疗立法的现实路径和适宜使用的法律名称。

Objective：The legalization of New Rural Cooperative Medical System is a very important issue to be solved for its further development. By analysis tool of soft law, and based on constitution, it had formed a legal framework with different soft laws in the New Rural Cooperative Medical System. To keep the New Rural Cooperative Medical System from failing to development,the soft law of New Rural Cooperative Medical System should obtain the character of rationalization and hard law.
