论昆曲发展及其知识产权保护

On the Kunqu Opera's Development and Protection under the Frame of Intellectual Property Rights

作为中华民族传统艺术中的瑰宝,昆曲被誉为"百戏之祖";作为人类智力活动的产物,昆曲被联合国教科文组织宣布为人类口述和非物质文化遗产代表作,是知识产权的客体。昆曲的保护机制与知识产权制度存在一定共通性,利用知识产权进行昆曲保护是重要的法律选择。昆曲知识产权保护在于通过对权利主体的保护来实现昆曲艺术的保护,即通过著作权保护、商标权保护、专利权保护等制度来保障相关知识产权主体的精神权利和财产权利,实现对昆曲发展和传播中社会关系的调整,进而促进我国昆曲的传承、创新与发展。

As the human intelligence activity＇s product,the Kunqu Opera is honored as ＂the ancestors of the Chinese opera＂,and is the treasure of Chinese national tradition art.It has been announced as the intangible cultural heritage by the United Nations Education,Science and Culture Organization,and is the object of intellectual property rights.Kunqu Opera＇s protection mechanism and the intellectual property system exists compatibility to some extent,and it is an important legal choice to use the intellectual property rights to protect the Kunqu Opera.Through constructing pattern of copyright,trademark rights,patent rights and the geography marking protection,we may come to the realization of adjusting the relations between the Kunqu Opera＇s development and communication,and promote the Kunqu Opera＇s inheritance and innovation in China.
