Guardianship and Protection of the Elders:On the Functions of Guardianship

对于监护制度的功能,存在着"行为能力补充说"、"亲权延伸说"和其他一些学说。但是无论从历史的角度还是现实立法的角度进行分析,监护制度最为根本的功能还是弱者保护。对监护制度功能的深入理解有助于我们在立法和实践层面进行探索,尝试将包括老年人在内的更多社会弱势者纳入监护制度的保护范围。

There are different theories concerning the function of guardianship,among which are the theory that the function of guardianship is to complement the ward＇s legal capacity and the theory that the function of guardianship is to extend the paternal power.But from the perspective of history and the practice of legislation,the function of guardianship is to protect vulnerable social members in its nature.This profound interpretation of the function of guardianship may be beneficial for us to cover more social vulnerable members,including the elders,under the protection of guardianship.
