中、俄“灰色清关”事件与中、美“轮胎特保案”事件的法理比较分析

中俄"灰色清关"事件与中美"轮胎特保案"事件,都是在华尔街金融危机的时代背景下,俄美两国政府迫于其国内压力而采取行动,给中国相关外贸企业造成重大损失,并且极可能带来连锁反应和造成深远影响的重大外贸事件。本文通过对两事件的比较分析,对我国如何处理好与不同类型国家的贸易摩擦进行有益的探讨,进而提出,加强对经济转型过渡期、法制环境不太完善的非WTO成员国家与我国贸易摩擦事件的研究已是一个刻不容缓的课题。

Both the gray customs clearance in Sino-Russia and the tire case of special protection in Sino-U.S.were notable foreign trade events result in the action of the governments of Rassia and U.S.under pressure at home under the international financial crisis,by which the relevent foreign trade enterprises in our county suffered significant loss and would set up a chain of reactions and have potentially farreaching consequences.This thesis is an explosive discussion on how to deal with trade conflicts between our county and the different counties by comparing and analyzing these two events,and put forward a proposal that it has become a burning issue to strengthen the reseach on the trade conflicts between our county and the counties which have been still in the stage of economic system transition and have no a faerly sound legal sys-tem,and not the members of the WTO.
