论我国虚拟财产的法律保护

On the Legal Protection of Fictitious Property

随着互联网技术的不断发展,由其产生的的新生事物也越来越引起人们的广泛关注和争议。虚拟财产作为财产权客体的一种,有着有别于其它财产的特殊属性,因此需要受到法律的特殊保护。但要通过何种法律途径和手段对虚拟财产进行保护,则需要对其法律性质加以明晰的界定。正基于此,笔者试图从学理上对其进行分析和探讨,并对其法律定位等方面提出自己的看法和建议,以期能对我国虚拟财产的法律保护有所裨益。

With the rapid development of the society, more and more people become to concern the new things broght by the net. And the internet fictitious property has got enough attention now. As a special kind of property, it needs the special protection by law. Today net space has resulted in some problems, which is vacant in law. Fictitious property is one of them and it has the common attribute of the legal property. It also has some special attributes. Many foreign countries have stipulated laws to protect it. Our country must recognize this form of property by law and protect it. It＇s the crucial time for us to do something for the fictitious property on the internet. Therefore, the author gives some suggestions in order to safeguard the salty of the internet world.
