About Originality of Works: Taking Literature Works as an Example

作品是著作权的重要客体之一,其中有形再现和独创性是其本质要求。《伯尔尼公约》缔结的一个重要原因是对艺术家独创性艺术成果的保护的迫切呼吁,文章试拟在对作品划分为艺术作品和非艺术作品的基础上,着重就艺术作品中的语言文学作品的独创性问题提出了一些看法,具体体现在语言文学作品的语言、主题、情节、场景、角色、结构诸要素方面。

Works is one of important objects of copyright,in which the visible representation and originality are its essential requirements.An important reason for the conclusion of the Berne Convention is that the artists urgently appeal to the protection of the outcome.This text divides the works into art works and non-art works.Then the author put forward some views of originality in the language literature works,which embodied in the language sign,plot,setting,character,structure etc.
