侗族婚姻习惯法在司法中的适用研究——以三江侗族自治县八江乡和林溪乡为例

Research on the Application of the Marriage Customary Law of the Dong Nationality to the Practice of Justice

构建侗族地区社会和谐发展,解决好在发展经济转型过程中出现的各种民事纠纷,有必要在司法实践中对侗族婚姻习惯法的宽容和合理利用,以此改善民族地区司法的纠纷解决能力及社会效果,提高司法的公信力和亲合力。文章结合在三江侗族自治县八江和林溪两个乡镇的实地调查,就实现国家法和侗族婚姻习惯法在司法实践中的良性互动作了探讨,期以促进侗族地区社会和谐发展奠定基础。

In order to build a harmonious society in the Dong nationality areas and solve the civil disputes in the process of economic restructuring, it is necessary to tolerate and properly use the marriage customary law of the Dong nationality. It can help improve the capacity and social effects of solving civil disputes and the credibility of justice in those areas. Combined with their field survey at two towns in Sanjiang Dong Autonomous County, this paper explores the application of the marriage customary law of the Dong nationality to the practice of justice with a view to promoting the harmonious development of the Dong nationality regions.
