摘要
新闻侵权行为较之一般侵害人格权益行为有其特殊性,尤其是在"违法性"上必须具备三个构成要素,即:一是侵权性的新闻作品已经公开传播;二是侵权性新闻作品的内容必须具有特定的指向性;三是已传播的新闻作品违反了保护人格权益的法律规范。
The tort in news is with special characteristics.Illegality must to be with three structural factors-first,news had spread publicly;Second,the content of the tort news must have the special meaning;third,the public news has broke the law regulation to protect personal rights.
