论自然保护区法律中的利益协调

On the Coordination of Interests in the Legislation of Nature Reserves

建立自然保护区是保护自然环境和自然资源,维护生态平衡的重要措施。目前,我国自然保护区在"数量"上增长迅速,但"质量"提升却相对滞后,自然保护区遭到破坏的事情时有发生。其中重要的原因是在自然保护区的建立和发展过程中,环境利益和经济利益以及利益主体间利益的不协调、不平衡。本文首先从探讨自然保护区法律的利益协调功能入手,分析目前我国自然保护区立法中的利益平衡内容的缺失,再针对问题提出立法完善上的解决途径,达到平衡各方面利益、促进自然保护区的可持续的发展的目的。

The establishment of nature reserves is the important protection measure to protect the natural environment,natural resources and to maintain ecological balance.At present,nature reserves increase quickly in ＂quantity＂,but relatively slow in ＂quality＂.The destruction of nature reserves often occurred.The key reason is the imbalance of environmental interests and economic interests during the creation and development of nature reserves.This thesis analyses the absence of interest balance contents in the legislation of nature reserves.And then it brings forward the solution of legislation,in order to balance the interests of all the aspects and to reach the goal of sustainable development of nature reserves.
