论政府对社会组织管理的机制创新——“民办非企业单位”引发的行政法思考

On Mechanism Innovation of Social Organization Management by the Government——Administrative Thought on Private Non-enterprise Units

"民办非企业单位"是现行法的一个称谓,属于社会组织的范畴。政府对民办非企业单位实行双重许可,体现了管制的社会管理理念。顺应行政社会化趋势,国家应当鼓励和扶持社会组织的发展,实现管理体制、方式和理念的创新,建立起合作伙伴关系,充分发挥社会组织在社会管理中的协同作用。

Being an appellation in the positive law,private non-enterprise unit belongs to social organizations and its management system of double licenses presents the social management concept.Therefore to accommodate the trend of administration socialization,the state should encourage and support the development of social organizations to achieve innovation of management system,method and concepts.Meanwhile,partnership should also be set up to fully develop the cooperative role of organizations in social management.
