我国水库移民权利保障发展评析

Comments on the Development of Reservoir Resettlement's Rights Protection

水库移民问题的实质是权利问题。从公民权利视角出发对建国后我国水库移民权利保障的发展情况进行了分析与评价,得出随着水库移民相关法律法规的出台和不断完善,我国水库移民的财产权和生存权保障取得了较大发展,知情权、参与权和监督权实现了从应然权利到法定权利的巨大转变。但分析同时表明现阶段我国水库移民的财产权保障仍有较大提升空间,目前立法对发展权重视不够,移民的参与权在政策上虽有提及,但其实现方式和实现途径尚需明确,移民的社会保障权和申诉救济权在相关法律上还是空白,亟待立法完善等。研究以期对进一步调整和完善水库移民政策法规,实现水库移民权利的充分保障提供决策参考。

The problem of the reservoir resettlement is essentially the problem about whose rights.From the perspective of civil rights,this paper analysis and evaluates the resettlement＇s rights in China from the year 1950.The results shows that with the development of relevant law and policies,reservoir resettlement＇s property right and existence right have made great development,knowing right,participation right and supervision right have been from natural right to legal right.But the analysis also shows in current law of China,there is big room for promoting resettlement＇s property rights,and whose development right is not paid enough attention.It also shows in the relevant policies that talk about the participation right,but the way to participate is not clearly presented.And the social security right and appeal right is still blank in the current law and need to be legislated.The paper is expect to provide some useful information for adjusting reservoir resettlement＇s policies and regulations in the future.
