Study On the Circumvention of Anti-dumping and Anti-circumvention Rules

反倾销(anti-dumping)之规避(circumvention)是国际竞争手段更加隐蔽、竞争形势更加激烈的产物,而反规避(anti-circumvention)制度是国家加强对外贸易管理,维护国家利益的体现。在深入分析欧美反规避制度立法与实践的基础之上,探讨了建立世界贸易组织体制之下统一反规避制度的可行性,并结合我国实际讨论完善我国反规避制度及如何应对外国反倾销主管机构针对我国企业发起的反规避调查的相关问题。

The circumvention of the anti-dumping measures is the result of international competition means is more hidden and the situation is more fierce.The anti-circumvention rules shows the country＇s strengthen management and maintenance of national interests in the field of international trade.This paper analysed in depth about anti-circumvention rules in the legislation and practice of American and EU.And then talked about how to establish the world uniform anti-circumvention rules under the system of WTO.In the end the author discussed the way about how to improve our country＇s anti-circumenvention rules and how to solve the foreign country＇s anti-dumping suit against our countries＇company.
