我国海岛生态安全问题研究:国家海岛保护法律——从香港海岸公园及海岸保护区法律中得到的启示

Research on China's Ecological Security Problems:Inspiration of Laws of Hong Kong Marine Parks and Marine Reserves on China's Law of Island Protection

海岛生态安全牵涉到国家安全与环境生态安全,各国均非常重视。但长期以来,国家在这方面的法律都是空白的。然而,经过多年的讨论与立法程序,全国人大常委会最终于2009年12月26日通过了我国第一部海岛综合管理、保护与开发利用的法律──《中华人民共和国海岛保护法》,对海岛的保护、开发与利用作出了明确的规定,填补了我国法律上的空白。但是,新通过的海岛保护法律还有许多不足之处,对此可借鉴香港海岸公园及海岸保护区法律在生态安全保护方面的经验,以完善我国海岛保护法律。

Island＇s ecological security involves national security and environmental ecological security.Nations in the world always attach great importance to it.However,China＇s law in this area is blank for a long time.After years＇ discussion and legislative procedure,Standing Committee of the National People＇s Congress has endorsed China＇s first comprehensive laws of island management,protection and development： ＂The People＇s Republic of China Island Protection Law＂.The law has passed,but how will it be implemented？ What would be its effectiveness？ We have to wait and see.This essay would look into the problems regarding ecological security faced by China,inadequacies of the newly passed island protection law and introduction of the experience in ecological security protection of Hong Kong marine parks and marine reserves laws.It is hoped that we can get inspiration form the aforesaid and make proposal to perfect China＇s island protection law.
