互联网技术的发展与知识产权制度的完善——以网络环境下版权滥用为视角

近年来,关于网络版权的纠纷与争议不断涌现,其根源在于互联网技术的发展与我国知识产权制度的完善之间并不协调。金融风暴下,互联网产业的发展面临瓶颈,知识产权制度的完善应当是谨小慎微的,新的政策方向,新的制度出台,牵动的都是整个互联网行业的发展前景。本文从版权滥用这一互联时代日益受到关注的新名词为切入点,对版权滥用的可诉性及合理使用的"权利化"展开论述,为如何在坚持传统民法与知识产权基本原则的前提下,有效解决互联网技术发展给知识产权制度带来的新概念、新矛盾提供思路。

In recent years,copyright disputes and co ntroversies are emerging on the Internet.Rooted in the development of Internet technology and our intellectual property system is not perfect coordination between each other.Under the financial turmoil,the development of the Internet industry is facing bottlenecks.Our intellectual property system should be cautious.The new policy direction,the new institution of law,all affect the development prospects of the entire Internet industry.From the new word of copyright-abuse,this article focus on the Suability of copyright-abuse and the ＂rights＂ of fair use;and how to solve the conflict between intellectual property system and ？the development of Internet technology effectively while upholding the basic principles of the tradition of civil law and intellectual property system.
