对西方违宪审查制度的反思

Reflections on Western Constitutional Review System

违宪审查制度是衡量一个国家宪政文明的重要标志之一。根据我国现行宪法的规定,我们也建立了违宪审查制度,但是到目前为止,全国人大及其常委员尚未作出过违宪审查的判决。通过对该制度在西方资本主义国家存在的不足之分析,希望对完善我国的违宪审查制度提供有益的经验和教训。

Constitutional review is an important indicator of a country＇s constitutional civilization. According to China＇s current constitution, we have also established the constitutional review, but NPC and Standing Committee made no judicial review of the decision. By the analysis of west capitalist countries about deficiencies of the system, hope to improve our system of judicial review provided useful experience and lessons.
