企业环境责任的法律制度研究

面对日益严峻的环境形势,如何健全法律法规,确保企业的环境法律责任得以实现,是一个重要而紧迫的问题。只有把宏观调控和微观管理相结合,才能使企业的环境责任得以较好地实现,因此,强调经济法规对企业的环境行为的调节十分必要,同时还应当加强绿色审计的监督及构建反不正当竞争法视角下的企业环境侵权诉讼制度。

Facing with the increasingly serious environmental situation,it is important and urgent for us that how to perfect laws and regulations to ensure the business to realize environmental legal responsibilities. We only make use of two kinds methods of macro - control and micro - management to adjust enterprise＇ s behavior, enterprise＇ s environmental responsibility can be better achieved. Therefore it is necessary to emphasize economic regulations on the corporate environmental behavior, we also should strengthen supervisory role of green audit legal system and construct the enterprise＇ environmental infringement litigation system under the perspective of Anti - Unfair Competition Law and the construction.
