Effect and Law Measures Against Foreign Merger and Acquisition of China's Leading Agricultural Enterprises

2006年以来,我国加入世贸组织过渡期基本结束,农业领域外商投资出现了许多新情况、新问题。针对最近几年跨国公司对我国涉农企业进行的"斩首式"并购引发的农业产业安全隐患,通过分析我国农业龙头企业在我国农村经济发展、尤其是农业产业化发展的重要性,阐述外资并购我国农业龙头企业的诸多不利影响,提出应对的具体对策。

Since 2006, the transition period for China＇s access to the WTO has basically been over and there have been many new situations and new problems for foreign investment in the agricultural sector. In this paper, the author mainly deals with the risk of the agricultural industry safety because of the ＂decapita- tion-type＂merger and acquisition of agriculture-related enterprises by multinational companies in recent years. The author analyses the importance of the leading agricultural enterprises in the development of China＇s rural economic development, especially the agricultural industrial development, sets forth the adverse effects of foreign mergers and acquisitions on the leading agricultural enterprises,and offers the specific measures.
