由文档分享网站谈版权问题的法律规制——以影响性案例为切入点

Talking of the Legal Regulation of Copyright Problem by Documents Sharing Websites

近段时期以来,文档分享网站饱受争议,一方面作为新兴的文档传播模式为很多人所追捧;另一方面又因版权问题所困扰。由"盛大诉百度事件"引发的争议,我们不得不重新审视网络版权问题所面临的法律争议。版权保护问题不仅是我们国家在贸易活动中应当肩负起的重要责任,同时也有助于我国文化产业的健康发展。因此,在借鉴国外文档分享模式的基础上,我们试图寻求新的版权保护方式,并希望通过著作权集体管理组织这一维权途径,解决目前侵犯版权所引起的纠纷。

In recent years,document sharing websites have caused a great controversy.On one hand,quit a few people,as a new document dissemination pattern,praise it,on the other hand,it is plagued by copyright problems because of the case of ＂Shanda v.Baidu＂.Thus,we have to rethink network copyright problems faced by the legal dispute.Copyright protection issue not only shoulders a key task in trade activities in our country,but also improves our cultural industry for healthy development.Therefore,in reference of foreign document sharing basis,we try to solve the copyright infringement disputes through the management of copyright organization form.
