我国高校学生纪律处分问题论要——基于处分的总程序之维 被引量:3

摘要 2005年我国颁布了《普通高等学校学生管理规定》,该规定颁布实施至今已长达5年之久。这期间各高校根据《规定》的相关精神,纷纷修订、完善了学生违纪处分条例,这对科学合理的进行学生处分法定化起到了重要的作用。然而通过对我国50所高校纪律处分规定的分析认为,在纪律处分总程序维度,高校对违规违纪学生的纪律处分仍存在诸多瑕疵,并未完成真正的程序正义转型,因此,构建这些程序对我国高校纪律处分程序的科学化和合理化运行具有较强的现实意义。 In 2005,The regulation of students in higher institutes was promulgated in China,it has been a long time of five years since its promulgation and enforcement.According to the relevance spirit of this regulation,many colleges and universities revise and perfect student discipline-violation punishment regulation,it plays an important role in carrying out student punishment rationally.Through an analysis of fifty colleges and universities disciplinary punishment regulation,we find that there are still a lot of problems in solving discipline-violation student,and not completed the transforms of real procedure justice,and it has stronger practical and immediate significance for the scientification and rationalization operation of disciplinary award procedure to build these procedure.
