摘要
宽严相济刑事政策与"严而不厉"属于不同阶位的术语,两者在产生背景、基本内涵、基本定位与侧重点等方面有些分野;然而,刑事政策的基本载体就是刑法结构,两者在观念层面与实践层面等方面具有一致性,可谓殊途同归。
Criminal policy of temper justice with mercy and＂strictness but unseverity＂are two terms of different rants with diifferent backgrounds,diifferent connotations,diifferent orientions,and diifferent focuses,but the basic carrier of criminal policy is the structure of criminal law,thus the two can be united in concept and practice.
