公司治理中的职工参与制探析

职工参与公司治理制度的价值在于为劳资双方提供一个真正平等的制度平台,有了这样明确的平权意识和具体制度,才能真正实现劳资合作与经济民主,进而促进社会生产力发展与实现全社会的基本公正。在职工参与制的问题上,我国应以现有相关立法规定为基点,构建劳动权本位的综合职工参与制度体系,即对职工董监事制度、职工代表大会制度进行合理化的改造,完成我国职工参与制的实现机制与保障框架。

The value of staff participating in the corporation governance is that it offers a truly equal system platform for labor and capital.With such a clear sense of equal rights and the specific system,it is possible to realize the labor-capital cooperation and economic democracy,and then promote the social productivity development and realize the basic social justice.On the problem of staff participation system our country should take corresponding legislation as basic point to construct comprehensive staff participation system which takes labor rights as orientation,namely reform reasonably workers-directors and workers-supervisors system as well as workers congress system,meanwhile fulfill the realization mechanism and security framework of staff participation system in our country.
