出租作为土地承包经营权的流转方式之一,既可以将土地的所有权与使用权进一步分离,使产权明晰化,又可以促使土地与其他生产要素优化组合,提高生产率。但是就中国目前的立法而言,存在诸多问题。从分析土地承包经营权出租的主要法律特征入手,在理清土地承包经营权出租的主体资格的基础上,对实践和立法中存在的问题予以分析并加以完善。

Ground lease,as one exchange method of contractual operation right of land,not only further separates the ownership and use right of land,and makes the property right perspicuous,but also promotes the optimization grouping among land and other agents of production,and raises productivity.However,there are many problems in the current legislative procedure of China.The paper analyzed the major legal features of ground lease in contractual operation right of land firstly.After getting the subject qualification of ground lease in contractual operation right of land into shape,it analyzed the conflicts between practice and legislation and put forward the perfecting countermeasures.
