代建制合同中的奖励和处罚条款直接关系到合同的执行力和实施效果。列举目前典型的代建制试行办法和合同中的奖励和处罚规定,运用委托代理理论和博弈论,分析奖励和处罚条款的设置机理,从代建制和工程项目管理原理的角度剖析这些规定的必要性和应用可能带来的问题,提出有待进一步研究的问题。

The penalties and rewards terms of agent-construction contract have a direct bearing on the implementation of contract.This paper lists some terms and analyzes the mechanism of them by using the principal-agent theory and game theory,analyzes some problems caused by these terms from the project management perspective,gives some topics which need more research.
