WTO规则视野下的“碳关税”解析

Analysis on carbon tariff by the rules of WTO

美国以环保为名行贸易保护之实的"碳关税"矛头指向中国,中国认为该措施违反了WTO规则。美国会援引GATT第20条作为"碳关税"在WTO多边贸易体制内的依据,虽然环境保护符合WTO的宗旨,但是GATT第20条的规定并不明确,通过解释其适用条件是可以否定"碳关税"在WTO体制中的合法性的。如果"碳关税"措施真的付诸实施,发展中国家特殊和差别待遇的诉求是退而求其次的备用手段。

American Carbon Tariff which is actually trade protectionism in the name of environmental protection is pointing to China and China declared that it is inconsistent with WTO rules.America is likely to adopt Article 20 of GATT to support Carbon Tariff under WTO.Although environmental protection conforms to the purpose of WTO,the Article 20 of GATT is indefinite,it is possible to conclude the Carbon Tariff＇s inconsistency with WTO rules by interpreting the applying requirements of Article 20 of GATT.If Carbon Tariff is taken into effect,the appeal of special and differential treatment is a secondary way to take.
