摘要
社会和经济的发展导致作品创作的智力投资者和财力投资者分离,著作权的归属成为双方争夺的对象,我国的委托作品、职务作品和法人作品制度对此进行了规定。但是各类作品分类标准模糊、要件选择随意以及权利分配原则矛盾、分配规则粗疏,导致弊病丛生。因此从两种著作权观念的反思出发,结合我国的立法旨趣,针对非独立创作的实际情况,对我国著作权法规定的三类作品提出全面的整合意见。
Social and economic developments led to the separation of intelligence investors and financial investors in the cre- ation of works. The ownership of copyright has become the object of contention of the two sides, but China's system of commissioned works, service works and eorporate works provides the rules for this matter. However, there are a lot ofquestion in the provisions such as vague classification standards, random selection of elements, the contradiction of right allocation principles, deficient distribution rules, all of which result in the various problems.
