法律适用统一,既是国家法制统一的应有之义,也是司法公正的必然要求。实践中不同程度存在的"同案不同判"现象,成为司法不能够承受之重,使得法律适用统一受到严峻挑战。加强案例指导、统一裁判尺度,日益成为理论界和实务界关注的对象,并被列入"法院二五改革纲要"。从分析建立案例指导制度的司法社会价值入手,着重就阻碍案例指导前行的理论误区进行正本清源,在此基础上对建立我国独具特色的案例指导制度提出建设性构想,包括分别建立全国统一和省级地方案例指导制度,赋予指导性案例法律适用效力等。

The unification of the application of law is not only absorbed in the meaning of the legal system, but also is a necessary requisition of the judicial justice. ＂Same case, different sentences＂ is a serious problem, and which is the serious challenge of the unification of the application of law. Strengthening the case guiding and unifying judgment is valued by people. On the base of theoretical analysis the article studies the constructive ideas. We should build the case guiding systems in the countrywide and each province and grants efficiency to the case guiding system.
