和谐社会语境下我国纠纷解决机制之重构

To Reconstruct the Dissension-Solving Mechanism in the Context of Harmonious Society in China

面对社会变迁和多元化的利益冲突,传统的诉讼制度日益暴露出其内在的诸多弊端。为有效于纠纷解决、构建和谐社会,应当在立足我国国情、借鉴外国ADR制度的经验基础上,建立一个包括协商、调解、仲裁、诉讼等方式的,彼此相互协调地共同存在,相辅相成的,能满足社会主体的多样需求的程序体系和动态的调整系统,即多元化纠纷解决机制。

The ideal of ruling by law is to construct a harmonious society.Faced with the problem of social transition and the conflict of interests,the malpractices of the traditional legal system have been increasingly exposed.To effectively solve the dissensions and build a harmonious society,systems of procedure and dynamic adjustment,i.e.,a dissension solving system with multi-methods,should be built on the basis of national condition and the experiences of other countries to include negotiation,mediation,arbitration and lawsuit,and make them coexist in coordination,supplement with each other and satisfy various demands of the social subjects.
