本文从版权的角度对开放获取作了详细的阐述,并认识到了两者之间相互的影响,主题是探讨目前国内外主要的开放获取政策如何在版权法的框架内实施。文章从开放获取的发展历史、知识产权对开放获取的影响、主要国家开放获取的发展和版权法的制定修改以及我国在开放获取发展道路上应该注意的问题等4个方面,讨论了法律角度下开放获取的发展方向,分析了现行版权制度的缺陷,以及版权合理使用制度在数字化环境下受到的限制,最后对我国发展开放获取模式提出了见解。

This article gives a detailed description of open access from the perspective of copyright,and recognizes their mutual influences.The article mainly discusses how major open access policies are implemented within the framework of copyright law at home and abroad at present.Beginning with the development history of open access,the influence of intellectual property right on open access,the development of open access and the formulation and revision of copyright law in the main countries,and the problems China should pay attention to in the development of open access,the article discusses the development direction of open access from the perspective of law.The article also analyzes the deficiencies of the present copyright system and the limitations of the rational use system of copyright in the digital environment.Finally,the article puts forward some ideas of how to develop open access models in China.
