摘要
司法工作人员是相对特殊的群体,原因在于其职权的绝对性与不对等性。就司法工作人员的职务犯罪而言,犯罪状态呈现出部门间差异较大、罪名相对集中以及犯罪黑数大的问题。因此,对此类犯罪的预防必须要做到主动性以及针对性。财产申报制度、腐败排行榜两项制度的设置对于遏制司法工作人员的职务犯罪有着不同的针对性,但是其设立的模式以及需要突破的法理障碍仍然是亟待解决的问题。
Judicial officer is a relatively special group because of its absolute authority and asymmetry. Staff on the administration of justice in terms of job-related crimes, Inter-state crime shows quite different, including the relative concentration of charges as well as a large dark figure of crime. Therefore, the prevention of such crimes must be proactive and targeted. Setting Property declaration system and the Corruption Perceptions Index for two staff positions to curb criminal justice has a different target. However, the mode of its establishment and the need to break the legal barriers are still problems to be solved.
