在现行法律制度下寻求保护古典名著的有效途径,保护我国的优秀文明成果十分重要,国家应该成为行使古典名著权利的主体,并成立专门的古典名著保护机构,全面负责古典名著的保护工作,建立古典名著名册制度,搜集登记需要重点保护的古典名著,具体管理古典名著的登记、使用备案、监督使用和利益协调等工作,制作诚信档案。同时建立完善的古典名著纠纷解决机制。

In order to protect the Chinese classical masterpieces, it is very significant to establish a special organ for the protection of the classical masterpieces under the current legal system especially under the framework of copyright law. This special organ will take overall responsibility for the protection of classical masterpieces, and a roster system of classical masterpieces should come into being. The subject of the rights of the classical masterpieces should be switched as the state. In the course of fighting against abuse on classical works, the special organ may apply to corresponding models of administrative legal system.
