摘要
中国渔业互保协会(以下简称"协会")开展了渔民雇主责任保险,当雇员发生伤、残、亡事故后,协会按"伤残表"确定的标准给予赔偿。这既没保障雇主的利益,还有损渔民的利益。文章从分析雇主对雇员承担的赔偿责任和保险人在雇主责任保险中的责任担当入手,阐述了雇主责任险的赔偿范围和确定这个范围的依据,论述了"伤残表"不应作为雇主责任保险赔偿标准的理由;最后,提出了在新《保险法》体系下,防范雇主责任保险的风险应该从加强防范道德风险和严格执行理赔程序上努力。
